The Club shall be called ‘Cockerton Cricket Club’ (hereinafter referred to as the Club) and its purpose shall be to promote the amateur sport of Cricket in the Cockerton area of Darlington and community participation in the same.
The Club shall ensure a duty of care by adopting and implementing the:-
ECB ‘Safe Hands – Welfare of Young People in Cricket’ Policy and any future versions of the policy.
ECB Equity Policy Statement and any future versions of the policy.
The Club shall run two teams in the Darlington and District league, enter the respective league knockout cup competitions and any other cup competitions decided by the General Committee.
The Club colours shall be Green and Gold.
The Officers of the Club, who must be elected at the A.G.M. shall consist of :- Hon. President: Chairman: Vice Chairman: Treasurer: Secretary: Assistant Secretary and Club Welfare Officer.
The business of the Club shall be conducted by a General Committee which shall be elected at the A.G.M. and which shall consist of :- The Officers, Team Captains, Groundsman, any member acting as a League Officer and a minimum of four ordinary members of the Club. The Committee shall have the power to co-opt any person onto the Committee to remain until the next Annual General Meeting. Six shall form a quorum.
No proxy votes are to be accepted at any Club meeting.
The election of the Officers of the Club shall be by a show of hands, the election of Captains and Vice-Captains by a paper ballot.
An attendance record of the members of the General Committee shall be kept by the Secretary and placed before the Club members at the A.G.M.
The Annual General Meeting shall be held in the first quarter of each year.
Application for membership to the Club shall be made to the Secretary.
The membership of the Club shall be open to anyone interested in the sport on application regardless of sex, age, disability, ethnicity, nationality, sexual orientation, religion or other beliefs.
There will be different classes of membership and subscription on a non discriminatory and fair basis – Life Members, Senior Playing Members (18 and over), Juniors (under 18) and Social Members. The subscription levels will be such as to not pose a significant obstacle to people participating.
The General Committee may refuse membership, or remove it, only for good cause such as conduct or character likely to bring the Club or sport into disrepute. Appeal against refusal or removal may be made to the members.
The Club shall hold General Committee Meetings during the year, the number being determined by the General Committee.
An Extraordinary General Meeting may be called if a request, stating the business to be discussed, is signed by twelve members and sent to the Secretary. The Extraordinary General Meeting shall be held within 14 days of the request, with all members being given at least 7 days notice of the meeting.
Should the Captain of either team resign for any reason during the season, then the Vice-Captain will automatically become Captain. An Extraordinary General Meeting shall then be called in accordance with rule 11 to elect a new Vice- Captain.
The selection of the teams shall be entrusted to a committee consisting of:- Captains and Vice-Captains who will be elected each year at the A.G.M.
Subscriptions shall be decided at the A.G.M. in respect of:-

Juniors (18 and under on 1st September of the preceding year)
Social Members
This will also apply to match fees for:- Saturday/Sunday matches:-

A person’s Annual Subscription shall be due once a sum has been determined at the AGM. No person shall be considered for selection if they have not paid their subscription by the 31st May of that season and there are sufficient paid-up members available for selection. Club Membership will run from 1st April each year and will expire on 31st March the following year. Anyone joining the Club after the 31st May will be given 4 weeks to pay their Membership Fee.
Whenever there is a prolonged absence of a Captain or Vice-Captain, another senior player will be co-opted onto the selection committee at the discretion of that committee.
The accounts of the Club will be kept at a Bank and/or Building Society as determined by the Treasurer and agreed by the General Committee.
The property and funds of the Club cannot be used for the direct or indirect private benefit of members other than as reasonably allowed by the Rules and all surplus income or profits are reinvested in the Club. The Club may provide sporting and related social facilities, sporting equipment, coaching courses, insurance cover, medical treatment, away-match expenses, post match refreshments and other ordinary benefits of Community Amateur Sports Clubs as provided for in the Finance Act 2002.The Club may also in connection with the sports purposes of the Club:-
Sell and supply food, drink and related sports clothing and equipment.
Employ members (though not for playing) and remunerate them for providing goods and services, on fair terms set by the Committee without the person concerned being present.
Pay for reasonable hospitality for visiting teams and guests.
Indemnify the Committee and members acting properly in the course of the running of the Club against liability incurred in the proper running of the Club (but only in the extent of its assets) The Committee will have due regard to the law on disability discrimination and child protection.
The Club’s accounts shall be audited annually and presented to the Club at the A.G.M. by the Treasurer. The Auditor(s) to be appointed at the A.G.M.
Players refusing without sufficient reason to play for the team for which they are selected, shall not play for the other team without the consent of the selection committee. Any player habitually refusing to play for the team for which he is selected shall be dealt with by the General Committee.
Any member who is unable to take part in a match for which he has been selected must give notice to a member of the selection committee as soon as possible. In exceptional circumstances a team captain shall have the power to co-opt any player.
Questions as to the interpretation of the Club rules or management of the Club, not provided for in these rules, shall be referred to the General Committee.
No rule shall be made, altered or rescinded except by agreement of two-thirds of votes cast of members present at an Annual General or Extraordinary Meeting of the Club.
Notice of motion of alteration or addition to the rules shall be given in writing to the Secretary not later than 21 days prior to the date of the A.G.M. or at least 7 days prior to the date of an Extraordinary General Meeting at which it is intended to propose the motion.
The rules shall be binding on all members of the Club.
The members may vote to wind up the Club if not less than three-quarters of those present and voting support that proposal at a properly convened general meeting.The Committee will then be responsible for the orderly winding up of the Club’s affairs. After settling all liabilities of the Club, the Committee shall dispose of the net assets remaining to one or more of:-
to another Club with similar sports purposes which is a registered charity and/or
to another Club with similar sports purposes which is a registered CASC and/or
to the Club’s governing body for use by them for related community sports.
Interpretation of all the Rules must be consistent with the statutory requirements of Community Amateur Sports Clubs as first provided for by the Finance Act 2002.
